Terms of Use

These Terms of Use (“Terms”) govern your use of the LidTap iPhone application (the “App”), the website at lidtap.app (the “Site”), and related Universal Links written onto NFC tags. They form a contract between you and Alexandre Grisey (“we”, “us”).

By downloading, installing, or using the App or the Site, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use LidTap.

Purchases made through the App Store are also subject to Apple’s terms, including the Licensed Application End User License Agreement and Apple’s media and privacy terms. If these Terms and Apple’s terms conflict on a point Apple requires for store distribution, Apple’s terms control that point.

1. What LidTap is — and is not

LidTap is a convenience tool: you may attach a commodity NFC tag (such as NTAG213 or NTAG215) to a bottle, link it in the App, and tap your iPhone to record a timestamp. Optional reminders, a Today widget, and on-device statistics are offered as described in the App.

LidTap is not:

• a medical device;
• a diagnosis, treatment, or dosing service;
• medical, pharmaceutical, or nutritional advice;
• proof that you swallowed, applied, or otherwise took a product;
• a guarantee that a reminder will fire, that a tap will succeed, or that a log is complete or accurate;
• an emergency service.

A logged dose means the App associated a tap (or a Universal Link open) with a supplement record at a moment in time. It does not mean the right bottle was tapped, the recommended amount was taken, or that taking it was appropriate for you.

2. Your responsibility

You use LidTap entirely at your own risk. You are solely responsible for:

• whether, when, and how you take any supplement, vitamin, medication, or other product;
• reading labels, following a clinician’s instructions, and checking interactions and contraindications;
• which NFC tags you buy, stick, and link, and keeping each tag on the correct container;
• the names and data you enter;
• enabling or disabling notifications, and noticing whether a reminder actually appeared;
• keeping the iPhone, NFC hardware, and iOS version in a state that can read tags;
• backing up anything you care about (the log is local; we cannot restore it);
• complying with the law in your country.

We are not responsible for missed doses, extra doses, mix-ups between bottles, failed scans, silent notifications, empty NFC tags, third-party sticker quality, Amazon or other retailers, carrier or Apple service failures, or any health, financial, or other outcome that follows from how you use — or do not use — the App.

If you have a medical question, a suspected adverse reaction, or an emergency, contact a qualified professional or emergency services. Do not rely on LidTap.

3. Eligibility and licence

You must be old enough to use the App Store in your country and, in France, at least 15. The App is intended for iPhone. NFC features require a compatible physical iPhone; they do not work in Simulator.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, as permitted by Apple’s usage rules. We and our licensors keep all intellectual property in the App, the Site, and the LidTap name and artwork. You may not copy, modify, reverse engineer (except where the law cannot be waived), rent, or redistribute the App except as Apple’s rules allow.

4. Acceptable use

You agree not to:

• use the App for any unlawful purpose;
• interfere with the Site, Universal Links, or other users;
• misrepresent a tap log as clinical evidence;
• probe, overload, or abuse the Contact developer endpoint;
• attempt to circumvent Premium limits except by a legitimate purchase or restore through Apple.

We may refuse support or stop providing the App (including by removing it from the App Store) if you materially breach these Terms.

5. Free features and LidTap Premium

Without a subscription, the App may limit you to three supplements, two tags per supplement, seven history items, weekly statistics, and no CSV export. Limits may change in a later version; the App will describe what is free and what is Premium at the time you use it.

LidTap Premium is an auto-renewable subscription sold through Apple:

• Title: LidTap Premium
• Length: one year
• Product identifier: com.gsy.lidtap.yearly
• Price: as shown in the App and the App Store at the time of purchase (it may vary by country and tax)

Apple requires, and you acknowledge, that:

• payment is charged to your Apple ID at confirmation of purchase;
• the subscription renews unless you turn off auto-renew at least 24 hours before the end of the current period;
• your account is charged for renewal within 24 hours prior to the end of the current period, at the then-current price;
• you manage or cancel auto-renewal in your Apple ID account settings after purchase (iOS Settings → Apple ID → Subscriptions);
• any unused portion of a free trial, if one is offered, is forfeited when you buy a subscription.

Refunds, if any, are handled by Apple under Apple’s refund rules. Restore purchases in the App to reconnect an existing subscription on a device. We do not set the App Store price and cannot bill your Apple ID ourselves.

Subscription status is checked with RevenueCat. Availability of Premium features depends on Apple, RevenueCat, and network access when the App refreshes entitlements.

6. Third-party products and services

NFC stickers, Amazon listings, Apple hardware and software, RevenueCat, Mobiqo, Google Cloud (Contact developer), font and hosting providers, and any clinician or product you follow are third parties. Their terms and privacy policies apply to their services. A link (including “Buy NFC tags on Amazon”) is not an endorsement and we are not a party to your purchase of tags or supplements.

We are not liable for third-party outages, SDK behaviour, store policies, tag lock bits, or changes Apple makes to NFC, notifications, widgets, or Associated Domains.

7. No warranty

To the maximum extent permitted by applicable law, the App and the Site are provided “as is” and “as available”, without warranty of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

We do not warrant that taps will be captured, that reminders will be delivered, that statistics will be complete, that Universal Links will always open the App, or that local data will never be lost or corrupted.

8. Limitation of liability

You — not Alexandre Grisey — are accountable for how you use LidTap and for the consequences of that use.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of profit, loss of chance, business interruption, or personal injury or health outcome, arising out of or related to the App, the Site, NFC tags, reminders, logs, Premium, or your reliance on any of them, whether in contract, tort (including negligence), or otherwise, even if we have been advised of the possibility.

To the maximum extent permitted by applicable law, our total liability for claims relating to LidTap is limited to the amount you paid for LidTap Premium in the twelve (12) months before the claim, or ten euros (€10) if you paid nothing.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under French or other mandatory law, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence where such exclusion is prohibited. If you are a consumer in the European Union or the United Kingdom, you keep the mandatory rights that the law of your country of residence grants you. These Terms do not affect those rights.

9. Indemnity

To the extent permitted by law, you will indemnify and hold harmless Alexandre Grisey from claims, damages, and reasonable legal fees arising from your use of the App, your NFC tags, the data you enter, or your breach of these Terms, except to the extent caused by our wilful misconduct or as mandatory consumer law forbids.

10. Changes and availability

We may change the App, the Site, prices (as Apple allows), free limits, or these Terms. The current Terms are published at /terms. Continued use after an update constitutes acceptance, except where the law requires otherwise. We may discontinue LidTap at any time. Local data remains on your device until you delete it; we have no obligation to host your history.

11. Governing law

These Terms are governed by French law, without prejudice to mandatory consumer protection rules of your country of residence if you are a consumer in the EU, the EEA, the United Kingdom, or another jurisdiction that does not allow that choice of law.

Subject to those same mandatory rules, the courts of Bordeaux, France, have jurisdiction. A consumer may also bring proceedings in the courts of their place of residence where the law so provides.
